		<description>Yes, but &quot;states rights&quot; don&#039;t apply to things such as a Federal Income Tax return where one can file &quot;jointly as a married couple&quot;.  It seems an executive order could solve this or the traditional method of Congress making it into law is another option.  The problem there, is Republicans don&#039;t care enough to write such a law and the Democrats are too busy screaming &quot;equality&quot;, they can&#039;t see the forrest for the trees.</description>

Some would argue that Congress did not have the right to do that as it was already a state right under the 10th amendment and/or that the action was unconstitutional as it would violate one or more of the 9th, 10th, and 14th amendments to the U.S. Constitution.</description>

He talks about &quot;rights&quot; and is in a perfect position to grant them.</description>
