U.S. v. Brent Burke General Court Martial date set

Fort Campbell KY, 101st Airborne DivisionFort Campbell, KY – A trial date is set for May 1st, 2012 in the case of U.S. v. Sgt. Brent Burke.

Burke is charged with two counts of premeditated murder; one count of felony murder; one count of breaking and entering; three counts of child endangerment; and one count of obstructing justice/impeding an investigation.

Burke has been placed in pre-trial confinement at a civilian confinement facility and faces a general court-martial, which is the most serious level of military courts. At a minimum, it consists of a military judge, trial counsel, defense counsel, and at least five court members.

Under the UCMJ, like all criminal laws in the United States, Burke is presumed innocent unless and until proven guilty beyond a reasonable doubt.
