Exclusive update: Clarksville Mayor Kim McMillan plans to terminate Building and Codes director

City of ClarksvilleClarksville TN – This is an update of a story first reported by Clarksville Online.

Clarksville Mayor Kim McMillan intends to terminate Building and Codes Director Les Crocker.  In a letter dated November 14th, 2012, McMillan notified Crocker in writing, of her plans for termination.

“The purpose of this letter is to notify you of my intent to terminate your employment with the City of Clarksville as Director of the Building and Codes Department.  It is anticipated that your discharge will take effect on Wednesday November 21st, 2012.  This action is being taken against you based on the following causes specified in City Code, Chapter 10, Section 1.5-1002 which are supported by the numerous deficiencies identified in the attached internal audit:

(b) Incompetence or inefficiency in performance of duties;

(p) Conduct which adversely affects the employee’s job performance or operation of the department in which they are employed;”


McMillan states that Crocker’s record keeping for abatement cases has been deficient, making it difficult for employees of his department, and the city’s Finance and Legal Departments to process and recover costs for abatement services.

The mayor also cites Croker’s “unwillingness to deal with employee morale which has led to an unproductive and un-motivated team.  In addition to the inadequate management of your department, as identified in the internal audit report, you have previously received discipline for serious violations and incompetence.”

The internal audit being referred to indicated that poor record keeping and lack of co-operation with the county led to over $500,000 in unclaimed fines and fees.  Employee morale reached an all-time low earlier this year with the filing of several grievances by employees at Building and Codes.  An independent investigation by a Nashville Law Firm determined that three of the fourteen allegations made against Crocker “had merit for investigation.”

Jennifer Rawls, spokesperson for Mayor McMillan, said the mayor would “have no further comment” on the matter.

Crocker has the right to appeal the decision and his termination will not become final until he has had a chance to respond to Mayor McMillan’s decision.  Mayor McMillan’s office made it clear that nothing is final until Crocker has had a chance to appeal directly to the mayor and present reasons why he should not be terminated.
