Clarksville Police DUI Arrests for February 25th-March 4th, 2013

Clarksville Police DepartmentClarksville, TN – In an effort to bring more attention to drivers that drink and drive, the Clarksville Police Department is consolidating and publishing the circumstances which lead to the DUI arrest. They are arrests, not convictions.

Police made 14 DUI arrests from February 25th thru March 4th, 2013. The blood alcohol content levels ranged from .121-.201. Two of the DUIs were repeat offenders who had been previously charged. Five of those charged involved accidents.

Nathan Breeden, Nicholas Taylor, Victor Galloway, William Perry, Eric Barnes, Andre Higgins, Kelsey Hedges, Jeffrey Harvey, Theodore Hay, Jace Smith, Aaron Mauk, Richard Gilbreath, Dashawn Nicholson, and Peter Olson were arrested for DUI.
Nathan Breeden, Nicholas Taylor, Victor Galloway, William Perry, Eric Barnes, Andre Higgins, Kelsey Hedges, Jeffrey Harvey, Theodore Hay, Jace Smith, Aaron Mauk, Richard Gilbreath, Dashawn Nicholson, and Peter Olson were arrested for DUI.

Nathan Breeden

Nathan BreedenOn 2/25/13 at 10:14pm, Officer Coghill pulled up to a crash at 919 Richardson Street. He saw suspect Nathan Breeden running from the Dodge Intrepid involved in the crash. Mr. Breeden had a very strong odor of alcoholic beverage emitting from his person.

He first stated he was test driving the vehicle. He then said he was not driving. I did not see anyone else come from the vehicle. He did not do any FST’s or give breath or take blood test. His DL is revoked for not paying a citation. It was revoked on 7-22-2004. Mr. Breeden does not have a DUI history.

Charges: DUI, Implied Consent, DORL
Warrant For: Violation Of Probation

Nicholas Taylor

Nicholas TaylorOn 02/27/2013 at 01:57 hours, Officer Allen Pendarvis (38983) responded to a Driving Under The Influence at 101 Airborne Parkway. While on routine patrol officer Pendarvis ran the license plate on a Red Honda Civic, Tag AA06610. It came back registered to a ford vehicle. Upon making contact with the driver, Nicholas Taylor, officer Pendarvis observed an open container of vodka in the passenger side floor board.

Officer Dillard observed the smell of an alcoholic beverage on Mr. Taylor’s breath. Mr. Taylor then submitted to a series of SFST’s to which he performed poorly. Mr. Taylor was arrested for the suspicion of DUI and taken to booking where he voluntarily submitted to a chemical breath test. His license was suspended for failure to satisfy. Mr. Taylor was charged with DUI 1st and DOSL. He was given a warning citation or the registration violation and his tag was turned over to the state.

Charges: DUI and Driving on Suspended License
Bond: $2,000.

Victor Galloway

Victor GallowayOn 02/27/2013 at 23:38 hours, Officer Brittany Feinberg (2572) conducted a traffic stop on a blue Monte Carlo for crossing the center line three times and the white line once. I made contact with the driver, Victor Galloway.

Mr. Galloway had bloodshot, watery eyes and an odor of an alcoholic beverage about his person. When asked to step out of the vehicle, Mr. Galloway was unsteady on his feet. Mr. Galloway performed five SFSTs, which he performed poorly on. Mr. Galloway stated he had two Bud Light Platinums earlier in the day.

A check through NCIC showed Mr. Galloway’s license suspended for failure to appear with an action date of 03/06/12. Mr. Galloway consented to a blood draw to determine his BAC and was transported to Gateway Medical Center. BAC results are currently pending. Mr. Galloway had an active COR on file as well.  Mr. Galloway was arrested and transported to the Montgomery County Jail for DUI and DOSL.

Charges: DUI, DOSL
Warrants For: Contempt and Stalking served
Bond: $3,500.

William Perry

William PerryOn 02/28/2013 at 17:23 hours, Officer K.Belgarde (4759) responded to an accident at 1021 Crossland Avenue. Witnesses stated they saw a tall white male leaving the scene of an accident where the vehicle went into a ditch almost hitting a house.

I approached a man that a witness pointed out, he was identified as William Perry. While speaking with Mr. Perry I could smell alcoholic beverage from his person.  Mr. Perry would not perform  Field Sobriety tests. Mr. Perry was booked into the Montgomery County Jail for DUI, leaving the scene of an accident and Possession without a prescription.

Bond: $1750.

Eric Barnes

Eric BarnesOn 02/28/2013 at 23:07 hours, Officer Matt Ferrell (1481) responded to a Driving Under The Influence at 404 North 2nd Street. During a investigation in the parking lot of the Night Deposit, the suspect Eric Barnes was in control of the listed vehicle and backed into a patrol K9 vehicle.

I made contact with Mr Barnes who has slurred speech, unsteady on his feet, and had the strong odor of an alcoholic beverage on his person. Mr Barnes did attempt standard field sobriety test but was stopped for his safety. Mr Barnes was read the implied consent advisement and refused. Mr Barnes was convicted of a DUI in 2009, and blood was drawn from his person.

Mr Barnes was taken into custody and transported to Montgomery County Jail for booking.

Bond: $10,000.

Andre Higgins

Andre HigginsOn 03/01/2013 at 01:53 hours, Officer Jeffrey Jackson (6390) located a possible motorist assist on Tinytown Road and Trenton Road. I observed a silver Dodge Intrepid driving on two flat tires and I made contact with him as he pulled into the lot of the Great Escape movie theater.

I made contact with the driver, Andre Higgins, and I could smell an odor of marijuana coming from his vehicle. I asked Mr. Higgins to step from the car to perform a series of standardized field sobriety test and I could smell the odor of burnt marijuana coming from his person. Mr. Higgins performed the SFST poorly. I placed Mr. Higgins under arrest for DUI.

Search incident to his arrest I located two blunt marijuana cigarettes inside the vehicle and a bottle of 2mg Alprozolam. I searched Mr. Higgins and found a clear bag containing a green leaf material in his left shoe. The marijuana was recovered and field test positive for THC, the active ingredient in marijuana, and was turned into evidence. The total weight for the marijuana was 1.6 grams.

Mr. Higgins was transported to the Montgomery county jail. The vehicle was secured and left on the private parking lot of the movie theater. Mr. Higgins had blood shot eyes and slow speech. On the Walk and Turn he missed all the steps and stepped off t he line twice. Mr. Higgins refused the One leg stand claiming leg injury from a previous accident. Finger to nose, he missed twice with the left and once with the right. Romberg he estimated the passage of 30 seconds in 40 seconds.

Charges: DUI, Implied Consent, Simple Possession

Kelsey Hedges

Kelsey HedgesOn 03/01/2013 at 02:38 hours, Sergeant Galbraith conducted a traffic stop on a gray Chevy Silverado for hitting the median on North Second Street. He observed a silver pickup truck behind him at North Second Street and Riverside Drive drive over the center median strip fast enough to launch his front two wheels in the air about 7 inches over the strip before coming down on the other side. He sped through the parking lot in to the drive in lane. After ordering his food, he again sped around the building.

Officer Feinberg made contact with the driver, Kelsey Hedges. Mr. Hedges had an odor of an alcoholic beverage about his person, watery eyes, and slurred speech. Mr. Hedges was slow to get his license and other paperwork he was asked to get. Mr. Hedges performed four SFSTs to which he performed poorly.

He stated he came from the Gilroy and was hungry wanting some “Scottish” food. He then began to cry.  Mr. Hedges also stated that he takes depression medication and that he is not suppose to drink while on that medication.

I asked Mr. Hedges if he had any drugs or weapons in the vehicle. Mr. Hedges stated he had a machete and a tomahawk under his driver seat. I retrieved an 8 inch knife and a tomahawk from under the driver seat. Mr. Hedges consented to a breath test. Mr. Hedges was arrested and transported to the Montgomery County Jail for DUI and UCDW.

Charges: DUI, Unlawful Carrying of a Deadly Weapon
Bond: $750.00.

Jeffrey Harvey

Jeffrey HarveyOn 03/01/2013 at 23:44 hours, Officer Brittany Feinberg (2572) conducted a traffic stop on a gray Ford Taurus for Move Over Law. I was backing up Officer Gillespie on a traffic stop when the vehicle failed to move over into the other lane of travel and almost struck my vehicle.

I made contact with the driver, Jeffrey Harvey. Mr. Harvey had an odor of an alcoholic beverage about his person, watery eyes, slurred speech, and was slow to respond. Mr. Harvey stated that he was coming from the Coup. Mr. Harvey performed five SFSTs, to which he performed poorly. Mr. Harvey has no DUI history. Mr. Harvey was unable to provide insurance when asked.

Mr. Harvey was arrested and transported to the Montgomery County Jail for DUI, Move Over Law, and No Insurance. The owner of the vehicle took possession and was taken from the scene. Mr. Harvey consented to a breath test.

Theodore Hay

Theodore HayOn 03/02/2013 at 00:29 hours, Officer Matt Ferrell (1481) responded to a Driving Under The Influence at Kraft Street/College Street. While driving down Kraft Street, I observed the listed vehicle swerve in and out of its designated lane numerous times.

A traffic stop was made and I made contact with driver suspect Theodore Hay who had blood shot watery eyes, slurred speech, and an odor of an alcoholic beverage on his person. Mr. Hay was asked to perform the standard field sobriety test which showed several signs of impairment.

Mr. Hay was placed into custody for driving under the influence. Mr. Hay was read the implied consent advisement in which he consented to a blood draw. He had a previous driving under the influence in July 19th 2009. Mr. Hay was transported to Gateway for a blood draw, and then to Montgomery County Jail for booking.

Charge: DUI
Bond: $5,000.

Jace Smith

Jace SmithOn 03/02/2013 at 00:44 hours, Officer L.Balazy (6454) responded to a Driving Under The Influence at 1716 Madison Street. I observed a silver Toyota Tundra traveling north on Madison Street without its headlights on.

Upon contact with the driver Jace Smith, I noticed Mr. Smith’s eyes were bloodshot and his speech was lethargic. Mr. Smith stated that he was coming back from O’Neils and had a beer a few hours ago. Mr. Smith voluntarily exited his motor vehicle and performed three SFST’s. During this performance, I observed clues that would indicate alcohol impairment.

Mr. Smith was secured and the Tennessee Implied Consent was explained to the defendant. Mr. Smith elected to use the Intoximeter at Montgomery County Booking. Mr. Smith was transported to Montgomery County Booking.

Aaron Mauk

Aaron MaukOn 03/02/2013 at 02:50 hours, Officer Jeffrey Jackson (6390) observed a black Chevy Avalanche traveling East on Tinytown Road with a flat driver’s side tire. The vehicle was driving down the shoulder and then cut across three lanes where the vehicle proceeded down the median.

I conducted a traffic stop on Tinytown near Greenspoint Drive and I made contact with the driver, Aaron Mauk. Mr. Mauk had an odor of alcohol about his person.  I asked Mr. Mauk to perform a series of field sobriety test which was performed poorly. I arrested Mr. Mauk for DUI.

A search of his vehicle incident to arrest revealed a loaded Remington 1911 handgun. Mr. Mauk does not have a permit for this weapon and he was under the influence while possessing this weapon. The weapon was turned into evidence. Mr. Mauk was transported to the Montgomery County Jail.

Bond: $1,250.

Richard Gilbreath

Richard GilbreathOn 03/02/2013 at 03:18 hours, Officer J Platt (4959) responded to a Driving Under The Influence at 301 Providence Boulevard. A concerned citizen stated that a vehicle had backed onto Providence Boulevard from being parked at the Kangaroo Gas Station and that the driver was passed out.

I made contact with a red two door vehicle with Richard Gilbreath passed out on the driver side with his head on the steering wheel and his foot intermittently hitting the gas and revving the engine. The vehicle was half way on Providence Boulevard and half way at the gas station with the engine running.

I woke Richard Gilbreath up and asked him to turn off the vehicle and pull the parking brake. I smelled a strong odor of an intoxicating beverage about his person and he had bloodshot and watery eyes. I asked him to step out and he was unsteady on his feet. He was asked to perform Standardized Field Sobriety Tests in which he performed poorly.

He was taken into custody and read implied consent where he consented to give a breath sample. Richard Gilbreath was transported to the Montgomery County Jail where he gave a breath sample using the Intoximeter EC/IR II. He was booked for DUI.

Dashawn Nicholson

Dashawn NicholsonOn 03-02-13 at approximately 0340 hrs Jeff Lucenti responded to a hit and run accident at the intersection of Fort Campbell Boulevard and Britton Springs Road. Upon arrival I made contact with complainant Dallas Fisher.

Mr. Fisher stated that he was stopped at the intersection in the south bound lane waiting for the light to change. While he was waiting his vehicle was rearended by a white SUV, later identified as vehicle #1 Jeep Compass, driven by a male driver, later identified as suspect Dashawn Nicholson. The white SUV then drove away south bound on Fort Campbell Boulevard.

A vehicle matching the description of the hit and run vehicle was located in the parking lot of the Waffle House at 1683 Fort Campbell Boulevard. The SUV had damage to the left front corner with red paint transfer.

Ofc. Matos made contact with a male sleeping in the drivers seat of the white SUV. The subject, suspect Dashawn Nicholson, had glassy eyes and slurred speech. The SUV’s keys were in the ignition. Mr. Nicholson refused to participate in any Field Sobriety tests.

Mr. Nicholson was taken into custody for Driving Under the Influence. Initially Mr. Nicholson agreed to submit to a breath test. Mr. Nicholson gave three insufficient samples. Mr. Nicholson was booked into Montgomery County Jail for Driving Under the Influence, Implied Consent, and Hit & Run.

Bond: $1,500.

Peter Olson

Peter OlsonOn 03/03/2013 at 20:48 hours, Officer Thomas Biele (3123) responded to a Driving Under The Influence at 1818 Memorial Drive. Detective Chestnut is a Detective with the City of Clarksville Police Department. Detective Chestnut (the complainant) advised that he witnessed a black F-150 jump a curb on Madison Street and drive into the on-coming lane of traffic. The complainant followed the vehicle to 1818 Memorial Drive where it hit the garage door at that residence.

Peter Olson was witnessed getting out of the F-150 at the residence. Mr. Olson smelled of alcohol and had trouble standing and almost fell down multiple times. Mr. Olson had red glossy eyes and had to be held up by officers to keep his balance. The suspect did not do Field Sobriety Testing due to the risk of injury to his person. The suspect was read the implied consent law.

Charges: DUI, Implied Consent
Bond: $500.00.
